   An act to amend Sections 2 and 3 of Chapter 625 of the Statutes of
1991, and to repeal Section 10 of Chapter 620 of the Statutes of
1989, relating to state property.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 1695, Committee on Consumer Protection, Governmental Efficiency
and Economic Development.  State property.
   Existing law requires the Department of General Services to
perform various functions and duties with respect to state property.

   This bill would authorize the Director of General Services to
sell, exchange, lease, or transfer specified parcels of state
property and rescind the existing authority of the director to sell,
exchange, or lease other specified parcels of state property.  This
bill also would authorize the Director of Parks and Recreation to
exchange a specified parcel of state property.  The bill would exempt
the sale, exchange, lease, or transfer of the parcels from specified
provisions of the California Environmental Quality Act.  This bill
would designate funds into which the net proceeds are to be deposited
and would require the reservation of mineral rights, as specified.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


  SECTION 1.  Section 10 of Chapter 620 of the Statutes of 1989 is
repealed.
  SEC. 2.  Section 2 of Chapter 625 of the Statutes of 1991, as
amended by Chapter 731 of the Statutes of 1998, is amended to read:
  Sec. 2.  The Director of General Services, with the approval of the
State Public Works Board, may sell, exchange, or lease for current
market value or for any lesser consideration authorized by law and
upon terms and conditions and subject to reservations and exceptions
that the director determines are in the best interest of the state,
all or any part of the following real property:
   Parcel 1.  Approximately 0.95 acre, with a structure used as a
field office by the California Highway Patrol at 25111 The Old Road,
Newhall, Los Angeles County.
   Parcel 2.  Approximately 0.92 acre, with a structure used as a
field office by the California Highway Patrol at 60 North Highland
Springs Avenue, Banning, Riverside County.
   Parcel 4.  Approximately 1.08 acres, with a structure used as a
field office by the California Highway Patrol at 11050 13th Avenue,
Hanford, Kings County.
   Parcel 5.  Approximately 0.95 acre, with a structure used as a
field office by the California Highway Patrol at 79-500 Varner Road,
Indio, Riverside County.
   Parcel 6.  Approximately 1.92 acres, with a structure used as a
field office by the California Highway Patrol at 1800 East Childs
Avenue, Merced, Merced County.
   Parcel 7.  Approximately 0.73 acre, with a structure used as a
field office by the California Highway Patrol at Navahoe Road at
Highway 50, Meyers, South Lake Tahoe, El Dorado County.
   Parcel 10.  Approximately 0.94 acre, with a structure used as a
field office by the California Highway Patrol at 19055 Portola Drive,
Salinas, Monterey County.
   Parcel 13.  Approximately 1.3 acres, with a structure used by the
Department of Motor Vehicles, located at 615 Locust Street, Redding,
Shasta County.
  SEC. 3.  Section 3 of Chapter 625 of the Statutes of 1991, as
amended by Chapter 391 of the Statutes of 1994, is amended to read:
  Sec. 3.  The Director of General Services, with the approval of the
State Public Works Board, may sell or lease for current market value
only, all or any part of the following property:
   Parcel 2.  Approximately 1.07 acres, with a structure used by the
Employment Development Department, located at 1313 Pine Avenue, Long
Beach, Los Angeles County.
   Parcel 3.  Approximately 0.43 acre, with a structure used by the
Employment Development Department, located at 660 Tule Street,
Mendota, Fresno County.
   Parcel 5.  Approximately 0.18 acre, with a structure used by the
Employment Development Department, located at 500 North Garden,
Visalia, Tulare County.
   Parcel 6.  Approximately 1.46 acres, with a structure used by the
Employment Development Department, located at 100 North Imperial
Avenue, El Centro, Imperial County.
   Parcel 7.  Approximately 0.63 acre, with a structure used by the
Employment Development Department, located at 240 West 7th Street,
Chico, Butte County.
   Parcel 8.  Approximately 1.17 acres, with a structure used by the
Employment Development Department, located at 346 Front Street,
Salinas, Monterey County.
   Parcel 9.  Approximately 0.85 acre with a structure used by the
Employment Development Department, located at 805 R Street,
Sacramento, Sacramento County.
  SEC. 4.  The Director of General Services, with the approval of the
State Public Works Board, may sell, exchange, lease, or transfer for
current market value only, all or any part of the following
property:
   Parcel 1.  Approximately 0.98 acre, with a structure used by the
Employment Development Department, located at 1301 Pine Street,
Redding, Shasta County.
   Parcel 2.  Approximately 6.64 acres, formerly the site of the
Cohasset Forest Fire Station that was partially destroyed by fire on
February 1, 1995, located at 405 Vilas Road, Cohasset, Butte County.

   Parcel 3.  Approximately 0.66 acre, with a structure formerly the
site of the Lyons Valley Forest Fire Station, located at 17461 Lyons
Valley Road, Jamul, San Diego County.
  SEC. 5.  The Director of General Services, with the approval of the
State Public Works Board, may sell, exchange, or lease for a term up
to 66 years for current market value or for any lesser consideration
authorized by law and upon terms and conditions and subject to
reservations and exceptions that the directors determine are in the
best interest of the state, all or any part of the following real
property:
   Parcel 1.  An approximate 0.11 acre portion of the existing five
acre Sage Forest Fire Station located at 35655 Sage Road, Hemet,
Riverside County.
   Parcel 2.  An approximate 0.06 acre portion of the existing three
acre Loma Rica Forest Fire Station, located at 11485 Loma Rica Road,
Marysville, Yuba County.
  SEC. 6.  The Department of General Services may sell, exchange, or
lease for current market value or any lesser consideration that the
director determines is in the best interest of the state, all or any
part of the following described property:  that approximately 2.58
acres of vacant land at the easternmost end of the property occupied
by the Franchise Tax Board, located at 9645 Butterfield Way,
Sacramento, Sacramento County, and shown as Assessor Parcel
068-0210-027, Assessor's Office of the County of Sacramento.  This
sale, exchange, or lease shall be exempt from Sections 11011 and
following and 54220 and following of the Government Code.
  SEC. 7.  The Director of Parks and Recreation, with the approval of
the State Public Works Board and the Director of General Services,
may exchange for real property of equal value and upon terms and
conditions and with reservations and exceptions that are deemed to be
in the best interest of the state, all or part of the following real
property:
   Parcel 1.  Approximately 80 acres of vacant land at Oceano Dunes
State Vehicular Recreation Area, north of Oso Flaco Road near the
City of Oceano, San Luis Obispo County.
  SEC. 8.  (a) Notices of every public auction or bid opening shall
be posted on the real property to be sold under this act and shall be
published in a newspaper of general circulation published in the
county in which the real property to be sold is situated.
   (b) Any sale, exchange, lease, or transfer of the parcels
described in this act is exempt from Chapter 3 (commencing with
Section 21100) to Chapter 6 (commencing with Section 21165),
inclusive, of Division 13 of the Public Resources Code.
  SEC. 9.  (a) The Department of General Services shall be reimbursed
for any cost or expense incurred in the disposition of any parcels.

   (b) The net proceeds of any moneys received from the disposition
of any parcels described in this act shall be deposited in the
General Fund and be available for appropriation in accordance with
Section 15863 of the Government Code, except as follows:
   (1) The net proceeds received from the disposition of Parcel 1 in
Section 4 shall be deposited in the Employment Development Department
Building Fund.
  SEC. 10.  As to any property sold pursuant to this act consisting
of 15 acres or less, the Director of General Services shall except
and reserve to the state all mineral deposits, as defined in Section
6407 of the Public Resources Code, below a depth of 500 feet, without
surface rights of entry.  As to property sold pursuant to this act
consisting of more than 15 acres, the Director of General Services
shall except and reserve to the state all mineral deposits, as
defined in Section 6407 of the Public Resources Code, together with
the right to prospect for, mine, and remove the deposits.  The rights
to prospect for, mine, and remove the deposits shall be limited to
those areas of the property conveyed that the director, after
consultation with the State Lands Commission, determines to be
reasonably necessary for the removal of the deposits.
  SEC. 11.  The authorization to sell, exchange, or lease the
following properties is rescinded by Sections 1, 2, and 3 of this
act, as the concerned state agencies have reported that the following
properties are no longer considered surplus:
   (a) The parcel described in Section 10 of Chapter 620 of the
Statutes of 1989.
   (b) Parcel 12 of Section 2 of Chapter 625 of the Statutes of 1991.

   (c) Parcel 4 of Section 3 of Chapter 625 of the Statutes of 1991.
